Do you represent U.S. persons or foreign financial institutions? Learn about Representation Strategies and Techniques for Undisclosed Foreign Financial Accounts and Assets

The IRS continues to make undeclared interests in foreign financial accounts and assets one of its top civil and criminal tax enforcement priorities. The number of U.S. taxpayers with interests in foreign bank accounts and assets is truly staggering.  The U.S. Government has established a special amnesty program for Swiss banks and with the implementation of FATCA, all other foreign financial institutions, including trust companies, broker/dealers, funds, and other financial-related businesses, are scurrying to become compliant before the FATCA withholding tax takes effect on July 1st of this year. This practical review explores the FBAR provisions and selected provisions of the Foreign Account Tax Compliance Act (FATCA) that are most relevant to financial institutions, individual taxpayers, the current status of the IRS' Offshore Voluntary Disclosure Program and other available options and issues surrounding the prosecution of non-compliant financial institutions and taxpayers.

This one-hour online webinar will bring you up to date on the evolving foreign asset reporting and compliance landscape and how FATCA generally affects non-US financial businesses. We will provide practical insights and guidance on foreign asset disclosure requirements, applicable penalty provisions, voluntary disclosures for delinquent FBARs, the methods the IRS is using to find non-compliant taxpayers, and more.

You and your clients cannot be caught unaware! Understand your clients' foreign asset compliance and enforcement obligations and the procedures for reporting on foreign assets.

Program Topics
  • Applicable Penalty Provisions and Defenses
  • Current State of the 2012 OVDP, Including the Treatment of Opt Outs
  • Consideration of Non-OVDP Filings of Amended or Delinquent Returns and FBARs
