Concepcion, Sexton, & Martinez, together with their team of forensic accountants and experts, recently obtained an Injunction Order effective through the State of Florida freezing various bank accounts, real property and other assets. The funds in the Florida bank accounts and the real property were traceable directly to other bank accounts in the Caribbean which had been opened with money converted from the firm’s Canadian clients. The Court which entered the Injunction Order relied on precedent established by similar cases previously litigated by Mr. Concepcion and his colleagues.
Carlos F. Concepcion, who practices in the area in the complex commercial litigation, recently obtained a seven figure arbitration award against a prominent securities brokerage firm and the broker who represented the investors. The investors were a husband and wife who sold their company for millions of dollars and invested all of their proceeds with one particular brokerage firm. The award was based on the failure of the broker and the brokerage firm to protect the investors by implementing customary hedging techniques designed to minimize losses in a portfolio that was heavily invested in one security. The claims against the broker and brokerage firm included negligence and breach of fiduciary duty.
